    i-POINT Consulting Services Pvt. Ltd. and its subsidiaries and affiliates (hereafter referred as "i-point") are committed to respecting your privacy, and providing a secure environment in which you can participate in on-line activities is important to us. This policy (“Privacy Policy”) discloses our privacy practices and expresses our commitment to keeping you informed of the information we collect and how it is used. We may update this Privacy Policy from time to time to reflect new uses, rules, regulations or technologies that impact your privacy.     You make the decision whether or not to proceed with any activity with the Web Site that requests personally identifiable information, but please be aware that if you choose not to provide the information requested, you may not be able to complete certain transactions with the Web Site. While you are using the Web Site, such as when you register for a service, order a product or make other requests or inquiries, we will ask for specific information about you in order to provide that product or service to you or to respond to your requests or inquiries. We may collect certain personally identifiable information such as contact details including name, e-mail address, work and home telephone numbers, fax number and a physical postal address. We may also collect information regarding your personal or professional interests, demographics, past experience with similar products and services, detailed contact preferences or other personally identifiable information.     We may also periodically conduct business and individual user surveys because they provide us with important information that helps us to improve our products and services. Participation in such surveys is completely voluntary and you, therefore, have a choice whether or not to disclose this information. Any personally identifiable information submitted in response to a survey will remain strictly confidential, subject to the provisions of this Privacy Policy.
    Data you submit online may also be combined with other information you provide through other means of communication, such as postal mail.
    As is true of most Web sites, we gather certain information automatically and store it in log files. This information includes but not limited to Internet protocol (IP) addresses, browser type, referring pages, date/time stamp and click stream data. In contrast to cookies, which are stored on a user's computer hard drive, Web Beacon clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence.) We do not tie the information gathered by clear gifs to our customers' personally identifiable information.
    We provide access to chat functions and discussion forums. If you use our chat functions or discussion forums to discuss issues with our sales or support or subject matter team, you might be directed to a third party host to facilitate such transactions. This Privacy Policy governs the collection and use of information collected within the chat area and via other online forums made available on the Web Site. If you choose to register for Webinars, you may be directed to third party sites. However, that our Privacy Policy governs the collection and use of the data collected these third party pages. No information is shared with these third party sites and they have no access or control of these pages.
  3. SHARING OF INFORMATION
    Unless we have your permission or is required by law, or as otherwise set forth in this Privacy Policy, i-point will not sell, rent, lease or otherwise provide your personally identifiable information to others, except in order to provide you with the products and services you request. i-point will only share the personally identifiable information you provide online with other i-point affiliates, i-point's partners and/or service providers who may be used to ship products, provide technical support, handle order processing, or otherwise act on i-point's behalf for the purpose of providing products and services, administering and operating the Web Site and our business and sending marketing and promotional communications. i-point may also share your information with its affiliates so that they may provide you with information about their own products and services and for other marketing and promotional purposes.
    Please remember that when you submit information to a discussion group or chat forum or some other public or online forum within the Web Site or elsewhere, such information submitted will be deemed public information and will not be considered confidential or treated by i-point as other personally identifiable information you specifically provide to i-point, which is subject to this Privacy Policy.     We may use your personally identifiable information for purposes not directly related to products and/or services you have requested or other requests or inquiries you have made, such as to send you e-mail communications, i-point's newsletter, information on new products or offers and information from i-point's partners unless you direct us not to do so by opting-out at the point where the information is collected. Additionally, you may opt-out from use of your personally identifiable information collected online for the purpose of sending such marketing or promotional communications at any time by changing your preferences in your profile or by following the unsubscribe instruction contained within each of the newsletters or promotional communications you receive.
  5. LINKS
    i-point may provide you with links to other sites that are owned or operated by third parties. Please be aware that i-point is not responsible for the privacy practices of these sites. i-point does not endorse them or make any representations about them or any information, services, products or materials found on them. If you decide to access any of the third party sites through links, we strongly encourage you to read their privacy statements.
    The Web Site may include and/or refer to certain websites hosted by third party service providers such as marketing analytics and payment gateways and education service/content providers which collect personal information and perform other tasks on behalf of the Web Site. Such third party web sites and pages may not be governed by this Privacy Policy.
  6. DATA SECURITY
    i-point may provide company information to our worldwide offices. The personally identifiable information you provide may be transferred to other i-point offices around the world. Also, in certain countries, i-point's outside contractors might undertake the collection, transferring and storage and processing of your personally identifiable information.
    Every i-point employee must abide by our Privacy Policy. Only authorized employees will have access to your personally identifiable information and such access is limited to a need-to-know basis. If, for example, you call us with a concern or complaint, the i-point representative is allowed to access the personally identifiable information that s/he requires to address your particular concern.
    We will take reasonable steps to safeguard personally identifiable information we collect from unauthorized access or disclosure and accidental loss, alteration or destruction. However, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personally identifiable information, we cannot ensure or warrant the security of any information you transmit to us or from our online services, and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems.
  7. HOW TO ACCESS AND CORRECT YOUR INFORMATION
    i-point strives to keep your personally identifiable information accurate and up-to-date. Should you find inaccuracies in your personally identifiable information and wish to amend, correct or delete the same, please contact us through one of the communication methods described below in Section 11, Contacting Us. i-point will respond to requests to update personally identifiable information within 30 days of the reception of the request.
    To opt out of all future marketing and promotional correspondence from i-point, please update your preferences in your profile or follow the unsubscribe instructions contained in the email communications you receive. Your request will be met within 10 business days.
  8. NOTIFICATION OF CHANGES
    i-point reserves the right to make changes to this Privacy Policy. If we make any changes that result in the use of personally identifiable information in a manner different from that stated at the time of collection, we will first notify you via e-mail and provide you with the choice as to whether or not you will allow us to use your information in this different manner. In the event there is a material change in our privacy practices that does not affect user information already stored in our database, a notice will be posted on our Web Site notifying all users of the change.
  9. CHILDREN
    i-point does not knowingly collect personally identifiable information from users under the age of 13. Children under 13 should not send any information about themselves to i-point. If a child under 13 submits information through any part of the Web Site, and i-point becomes aware that the person submitting the information is a child, we will attempt to delete this information as soon as possible.
  10. ACCEPTANCE OF PRIVACY POLICY
    By using the Web Site, you signify your assent to our Privacy Policy. If you do not agree with this Privacy Policy, please do not use our Web Site. Your continued use of this Web Site following posting of changes to these terms will mean you accept those changes.

Terms and Conditions

Access to and use of www.ogee.in, including the content, features, and any microsites, blogs and discussion groups that are a part of http://www.ogee.in (the “Web Site") are subject to the following terms, conditions and notices. By accessing the Web Site you accept and agree to be bound by the terms, conditions and notices set forth herein, including the Privacy Policy on the Web Site which is incorporated herein by this reference (this "Agreement"). To the extent that you have entered into a written agreement with i-POINT Consulting Services Pvt. Ltd. or any of its affiliates containing terms that directly conflict with any terms of this Agreement, then the conflicting terms set forth in the written and mutually fully executed agreement shall control. i-POINT Consulting Services Pvt. Ltd. (the "Company") may at any time and in its sole discretion, modify the terms of this Agreement by updating this page on the Web Site. Therefore, you should review this page from time to time so that you will be aware of any such modifications. Your continued use of the Web Site following any modifications constitutes your binding acceptance hereof.

The Company may post additional guidelines or rules, whether relating to particular subparts of the Web Site or otherwise (the "Subpart Terms") from time to time. Any Subpart Terms are hereby incorporated into this Agreement by reference; provided, however, that in the event of a direct conflict between any Subpart Terms and the terms set forth on this page, the terms hereof shall control.


Use of Material; Non-Commercial Purpose


The contents of the Web Site are protected by copyright and other laws in India and elsewhere. The contents of the Web Site include both content owned or controlled by the Company and content owned or controlled by third parties and licensed to the Company. Linked Sites are not under the control of the Company and the Company is not responsible for the contents thereof. These links are provided to you only as a convenience, and inclusion of a link does not imply endorsement of the Linked Site by the Company or any association with its operators. You acknowledge and agree that the Company shall not be responsible or liable for any damage or loss caused by or in connection with use of or reliance on any content, goods or services available on or through any Linked Site. The Web Site includes certain pages (“Branded Sites”) hosted by third party service providers. These Branded Sites are governed by this Agreement.


Internet Forums


In General. The Web Site from time to time may contain blogs, discussion groups, chat rooms and other online forums ("Internet Forums"). These are intended to provide users with a valuable resource on selected topics. Some, if not most, of the content found on such Internet Forums is provided by third party users, and not the Company. The third party user who is posting to an Internet Forum, and not the Company, is responsible for the content of such posting and for complying with this Agreement.


Standard of Conduct. You agree that you are responsible for your own communications with respect to the Web Site and for any consequences thereof, and you agree to use the Web Site and any Internet Forums only to post, send and receive messages and material that are proper and related to the Web Site or the particular Internet Forum. By way of example, and not as a limitation, you agree that when using the Website you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others; Publish, post, upload, distribute, disseminate or offer to do the same ("Post") any topic, name, material, information or other content that is unlawful, harmful, threatening, abusive, harassing, tortuous, infringing, defamatory, libellous, fraudulent, deceptive, disparaging inappropriate, profane, vulgar, obscene, indecent, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

Blog Policy. The content of the Web Site blog or any other Internet Forum reflects the thoughts and opinions of the author(s), and does not represent the thoughts, opinions, plans or strategies of the Company. The Company undertakes no obligation to update, correct or modify any statements made by the author(s) of the post. Any and all third party links or Linked Sites provided by the blog or Internet Forum are not affiliated with, nor endorsed by, the Company.


No Endorsement. The Company does not pre-screen or control the content of any posting to an Internet Forum and, as such, does not endorse, support, represent, or guarantee the truthfulness, accuracy or reliability of any communication posted or endorse any opinion expressed in any posting. You acknowledge that any reliance on material from the Web Site will be at your own risk. Moreover, you understand that by using the Web Site, you may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will the Company be liable in any way for the content of any posting, including but not limited to, any errors or omissions in its content, or any loss or damage of any kind incurred as a result of the use of any content posted.


No Obligation to Monitor. The Company does not control information delivered to the Internet Forums by third parties. Except to the extent specifically set forth in this Agreement, the Company has no obligation to monitor any Internet Forum, including for the purposes of removing material that is inaccurate, offensive or inappropriate or material which otherwise violates this Agreement. Notwithstanding the foregoing, the Company reserves the right to monitor, for any purpose, any use of the Web Site at any time.


Certain Company Rights. In addition to reserving the right to monitor, for any purpose, any Internet Forum at any time, the Company also reserves the right at any time (1) to disclose any information as necessary to satisfy any applicable policy, law, regulation, legal process, government request, or similar or (2) to edit, refuse to post or remove any information or materials, in whole or in part, for any reason whatsoever, in the Company's sole discretion.


You may report any communication that you believe to be contrary to any provision of this Agreement by sending e-mail to contact@i-point.co.in. If the Company discovers any communication that is alleged not to conform to any term hereof, then the Company may, but need not, investigate the allegation and determine in good faith and in its sole discretion whether to remove or request the removal of the communication; provided, however, that the Company will have no liability or responsibility for the performance or non-performance of such activities.


Intellectual Property. The Web Site is expressly owned and operated by the Company. Unless otherwise noted, the design features and content of the Web Site, including information and other materials, illustrations, product layout and design, icons, navigational buttons, images, artwork, graphics, photography, images, text, data, audio sound, software, and infrastructure, as well as the selection, assembly and arrangement thereof, are owned by the Company or its affiliates or are licensed from third parties by the Company. The Web Site, in whole and in part, is protected by copyright, trademark, service mark, trade name, and other intellectual property and other proprietary rights, and all such rights are reserved.


License. The Company does not claim ownership of the content you or other users provide, post, upload, input or submit to the Web Site. However, by posting or submitting content to the Web Site you are granting the Company a royalty free, perpetual, irrevocable, non-exclusive license to use your submission in connection with the operation of the Web Site and use by the Company in advertising, marketing and promotional activities and materials without compensation to you, such license to include the right to reproduce, modify, publish, edit, translate, distribute, perform, and display the submission alone or as part of other works in any form, media, or technology whether now known or hereafter developed, and to sublicense such rights.


Termination


The Company reserves the right, in its sole discretion, to terminate your access to and use of the Web Site or any part hereof, and to remove and discard any material posted by you hereon, for any reason whatsoever, including, without limitation, for lack of use or if the Company believes that you have violated or acted inconsistently with the letter or spirit of this Agreement; provided, however, that the Company will have no liability or responsibility for the performance or non-performance of such activities. The Company may also, in its sole discretion and at any time, discontinue operation of the Web Site, or any part hereof. Any such termination may be effected without any prior notice. Upon any such termination, the Company may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Web Site generally. Further, the Company shall not be liable to you or any third-party for any termination of your access to the Web Site.


Copyright Issues


The Company respects the intellectual property of others, and we ask our users to do the same. The Company may, in appropriate circumstances and at its discretion, remove, or disable access to material on the Web Site that it believes or is notified may infringe on the rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide the Company's Copyright Agent the following information:

    Indemnification


    You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, agents, affiliates and strategic partners from and against any third party claims, actions or demands, arising or resulting from your use of the Web Site or your breach of the terms of this Agreement. The Company shall provide notice to you promptly of any such claim, suit or proceeding and reasonably assist you, at your expense, in defending any such claim, suit or proceeding.


    Miscellaneous


    This Agreement is governed by the laws of the State of Karnataka, India. You hereby consent to the exclusive jurisdiction and venue of courts in Mangalore, D.K District, Karnataka, India in all disputes arising out of or relating to the use of the Web Site. Use of the Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions including, without limitation, this paragraph. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. This Agreement constitutes the entire agreement between the user and the Company with respect to the Web Site and supersedes all prior or contemporaneous communications, proposals, whether electronic, oral or written, between the user and the Company with respect to the Web Site.

Cancellation & Refund Policy


i-POINT believes in helping its customers as far as possible, and has therefore a liberal cancellation policy.

Under this policy:
  • Cancellations will be considered only if the request is made within 72 hours of placing an order. However, the cancellation request will not be entertained if the orders have been communicated to the vendors/merchants and they have initiated the process of shipping them.
  • There is no cancellation of orders placed under the Same Day Delivery category.
  • No cancellations are entertained for those products that are promoted on special occasions like Pongal, Diwali, Valentine’s Day etc. These are limited occasion offers and therefore cancellations are not possible.
  • In case you feel that the product received is not as shown on the site or as per your expectations, you must bring it to the notice of our customer service (support@ogee.in) within 24 hours of receiving the product. The Customer Service Team after looking into your complaint will take an appropriate decision.
  • In case of complaints regarding products that come with a warranty from manufacturers, please refer the issue to them.
